Subject: | Liability Protection for Easements to Landlocked Property |
In recent years, Pennsylvania Supreme Court decisions have whittled away at our Private Road Law to the point that landlocked property owners have very few options left. In many cases, the only option is to negotiate an easement with an adjoining landowner in order to gain road access. In the interest of putting landlocked properties to productive use, and to encourage the negotiation of voluntary private easements, in the near future I intend to introduce legislation to offer some measure of liability protection to those landowners with road frontage who convey an easement to neighboring landlocked properties. Modelled after the liability protection found in our Recreational Use of Land and Water Act, this liability protection may be one way to encourage landowners to help out a neighbor in need.
