Subject: Comprehensive updates to the Older Adults Protective Services Act
 

In the near future, I plan to reintroduce legislation to update the Older Adults Protective Services Act (Act 79 of 1987). Last session, HB 1930 generated several discussions with key industry stakeholders. These conversations were incredibly helpful in putting together much needed updates to the language from last year.

This legislation will refine employment bans for individuals convicted of certain crimes to address the Peake v. Commonwealth decision in 2015, update background check requirements, require financial institutions to include specific financial abuse training for their employees and clarify the local Area Agencies on Aging’s investigation processes.  

According to the Pennsylvania State Data Center, the Commonwealth is ranked fifth in the nation by the size of our older adult population. As we move further from the 2015 Peake decision, it is imperative that we update this law to ensure protections are in place for our older adults.
