Subject: Investigation into the failure to publish notice of the passage of House Bill 963 in the 2019-2020 Legislative Session
 
During the 2019-2020 Legislative Session, the General Assembly passed House Bill 963, which was a proposed constitutional amendment, by an overwhelming, bipartisan vote in both the House of Representatives and the Senate.  This Joint Resolution was signed in the two chambers of the General Assembly on November 21, 2019. It was filed in the Office of the Secretary of the Commonwealth on November 25, 2019, becoming Pamphlet Laws Resolution Number 2 (Joint Resolution 2019-2).

The publication of the notice of the passage of this proposed constitutional amendment by the Secretary of the Commonwealth did not occur in the manner required by Article XI of the Pennsylvania Constitution. This means that the proposed constitutional amendment cannot be presented to the People of Pennsylvania for their final approval until May 2023 at the earliest.

Almost 3 months have passed since this failure to publish the notice was announced, and the General Assembly still has not received a sufficient explanation for how this failure occurred.  The time has come for the General Assembly to find the answer for ourselves and the Commonwealth’s citizens.

I will be introducing a resolution to establish an investigation into the publication of proposed constitutional amendments under Article XI of the Pennsylvania Constitution.
