MEMORANDUM

Posted: April 20, 2021 11:41 AM
From: Representative Christopher M. Rabb
To: All House members
Subject: Commercial Tenant Protections for Medical Cannabis Dispensaries

Often commercial landlords refuse to rent commercial space or place unreasonable restrictions on medical cannabis dispensaries or medical providers. Without these state certified dispensaries, cancer patients, those trying to manage epilepsy, or other suffering patients will not have access to the medicine they need. As such, we need to provide these Pennsylvania businesses with protections and clarity so they can conduct their business without fear.

To protect commercial tenants that legally sell or provide medical cannabis, I will be introducing legislation amending the Medical Marijuana Act. This bill will protect commercial tenants that are permitted to prescribe or distribute medical cannabis without the constant threat of eviction. This legislation provides that no landlord may evict, threaten to evict, or otherwise discriminate against a commercial tenant for the lawful sale or possession of medical cannabis if the tenant is certified by the Commonwealth.

Please join me in co-sponsoring this imperative legislation so we can provide protections for these important Pennsylvania businesses.

Introduced as HB901
