| Subject: | Wording and Explanation of Ballot Questions for Proposed Constitutional Amendments |
| Under our constitutional amendment process, the General Assembly proposes amendments to the Pennsylvania Constitution and the voters get to decide whether to adopt that proposed amendment or not. Proposed constitutional amendments are not subject to a gubernatorial veto, and, except for certain duties that have been delegated to executive agencies, the Executive Branch is not involved in that process. Specifically, the Department of State has been tasked by the Election Code with determining the wording of the question that is placed on the ballot. The Office of Attorney General is charged with the duty to write an explanation of the ballot question in plain English. Our legislation would amend the Election Code to shift the duty for determining the wording of the questions and the explanations of ballot questions to the Legislative Reference Bureau.
