Session of 2021 - 2022 Regular Session

MEMORANDUM

Posted: January 29, 2021 03:25 PM
From: Representative Dan L. Miller and Rep. Brandon J. Markosek
To: All House members
Subject: Valuing employers who value Pennsylvanian workers

Pennsylvanian workers have literally built this country, and they continue to demonstrate a high level of productivity with a stellar work ethic. Unfortunately, as our economy continues to shift and change, some of our employees are ending up getting the short end of the stick. All too often, salaries, benefits, and pensions are cut, voices for safety or better working conditions are ignored, or efforts to organize are stymied - at a time when many executives are bringing home record compensation.

As such, we plan to re-introduce legislation that would require that, in order for a domestic or foreign business corporation with 200 or more employees to be eligible for a state contract, state funding, or a state grant, the business shall:
  1. Not have violated the Fair Labor Standards Act within the previous five years,
  2. Not have been found guilty of an unfair labor practice within the previous five years,
  3. Not have been found to have violated the Prevailing Wage Act within the previous five years;
And, when they have a governing board,
     4. File bylaws with the Department of State that show that at least 20% of their governing board must be
      employees elected by the workers of that corporation.

We believe that by requiring these minimal requirements we will be encouraging positive employer/employee relations and increasing the voice of employees when it comes to important business decisions. Please join us in co-sponsoring this legislation and working to ensure that Pennsylvania’s economy works for all of its citizens.
