Session of 2021 - 2022 Regular Session

MEMORANDUM

Posted: January 13, 2021 09:03 AM
From: Representative Tarah Toohil
To: All House members
Subject: Victim Access to Police Reports

I intend to introduce legislation making it easier for victims of domestic violence to obtain police reports concerning their own abuse.  Often, victims escape from violent relationships only by leaving behind their property, money, and identification.  To protect themselves, they may need to obtain copies of relevant police reports concerning past abuse, but lack the means to pay for those reports.

My legislation will require law enforcement agencies to make such reports available to victims, as well as officials from other government agencies working to protect a victim of domestic violence.  The cost of the report shall be capped at $25, but if a victim is either granted "in forma pauperis" status by a court or demonstrates that the victim is receiving services free-of-charge from a nonprofit organization dedicated to helping domestic violence victims, the report shall be provided for free.

Please join me in taking this step to protect our domestic violence victims.
