MEMORANDUM

Posted: January 8, 2021 09:44 AM
From: Representative Melissa L. Shusterman and Rep. Ed Gainey
To: All House members
Subject: Expungement Law Additions for the Wrongfully Convicted or Exonerated

In October 2020, Act 83 was signed into law, allowing for the automatic expungement of records for acquitted individuals.  While creating and passing this legislation was no easy feat, the current language could be confusing for some and does not explicitly state that wrongfully convicted or exonerated individuals may be included.

To combat this, we are introducing legislation to amend certain areas of the bill to include language regarding wrongfully convicted and exonerated individuals.  By including these terms, individuals who may have thought the bill does not apply to them will be able to connect themselves to it and the law will allow such individuals the right to an expungement.

As legislators, it is our duty to ensure the well-being and future success of all Pennsylvanians.  By including clearer language in our current expungement law, we can continue to right the wrongs the exonerated and wrongfully convicted have faced.  Please join us in co-sponsoring this legislation.
