Subject: Restaurant Pandemic Sales Tax Suspension
 
In the near future we will be re-introducing legislation to provide immediate assistance for the Pennsylvania restaurant industry, which employs over 580,000 Pennsylvanians.

All businesses in Pennsylvania have been significantly impacted by the COVID-19 pandemic. Most restaurants in Pennsylvania have made investments to their buildings and changed their internal policies to ensure they are operating safely and complying with the CDC’s COVID-19 mitigation guidelines. Additional restrictions on capacity have forced numerous restaurants to close and we are hearing from many restaurateurs that additional restaurants will close if they do not receive some sort of assistance.

Our legislation will allow restaurants to continue collecting sales tax for the sale of food and beverages within their establishments but not require remittance of this amount to the state until restrictions are removed, and they are able to operate at 100% capacity. A restaurant would be required to submit an application to the Department of Revenue and, if approved, would convert the amount of sales tax collected into a grant. If these restaurants close, the Commonwealth stands to lose far more revenue than the sales tax on 25 % capacity operations of these businesses.
