MEMORANDUM

Posted: December 14, 2020 02:47 PM
From: Representative Perry A. Stambaugh
To: All House members
Subject: Health Care Co-Ops Legislation

In the near future, I plan to introduce legislation which would allow health care co-ops to qualify for medical support under Title 23, child support orders.

Presently, Title 23 requires parents to provide health insurance to their children under a health insurance plan or government subsidized health care plan. Title 23 presently excludes other health insurance plans which are available on the market and regulated as health insurance in line with the Affordable Care Act.

Health care co-ops, such as those offered from Christian Healthcare ministries are not permissible for child in a child support setting even if the parents agree that the health insurance option is in the child’s best interest. As these are products considered health insurance by the Federal government, our state statute should be updated to reflect the parents’ ability to chose this option for their kids.
