MEMORANDUM

Posted: December 7, 2020 01:17 PM
From: Representative Anthony M. DeLuca
To: All House members
Subject: Affordable Care Act Resolution

The health care of millions of Americans hangs in the balance as the U.S. Supreme Court considers a legal challenge to the Affordable Care Act (ACA).

If the Supreme Court overturns the entire ACA, crucial consumer protections could disappear overnight. Health insurance plans could discriminate against individuals with preexisting conditions, drop young adults off a parent’s plan when they turn 19, impose annual and lifetime limits on the dollar value of care you receive, make cancer clinical trial participants pay for ancillary costs of care, and eliminate coverage of the ten essential health benefits.

Retaining these protections at the federal level will provide uniformity across the country. Accordingly, my resolution urges Congress to retain these crucial consumer protections if the ACA is ruled unconstitutional. I hope you will join me in supporting this important resolution.
