Subject: Blanket Immunity Under COVID-19
 
In the next day or two, we will be introducing legislation to address the extreme lack of clarity and consistency with the business waiver process that has sewn chaos and confusion amongst Pennsylvania’s stressed business owners.  Many businesses and nonprofits face uncertainty and frustration with respect to whether or not they are permitted to continue operations under Governor Wolf’s order to close all non-life sustaining businesses and fear the potential penalties and sanctions they could face.
 
Our proposed legislation will help alleviate this concern for many businesses, licensed professionals, nonprofits, school districts and political subdivisions in Pennsylvania. Our legislation will provide security for individuals, licensees, nonprofits, school districts and political subdivisions by ensuring immunity from civil and criminal liability and from imposition of administrative sanctions, including those by a professional or occupational licensing board or commission, if an individual is engaged in a protected operation during a declared disaster emergency and does not cause any actual harm.
