Subject:	Increasing eligibility for Extended School Year due to COVID-19

During the COVID-19 emergency, in-person learning has been suspended, and the challenges for all students have been considerable. Arguably, though, those challenges have been even been more difficult for students with an IEP. Many students with an IEP benefit from an Extended School Year (ESY), which provides a continuation of special education learning and related services over the summer at no cost to the family. Typically, data on the student's progress is collected throughout the year and then discussed with the IEP team to consider whether the student would benefit from ESY. Clearly, for over a quarter of the 2019-2020 school year, the majority of data sets have not been collected - at least not to their fullest degree. But students with an IEP cannot be made to bear the brunt of the COVID-19 crisis. Therefore, I am introducing legislation that will automatically make all students with an IEP eligible for ESY this summer. The option to attend ESY will be left to the parents and the students, and the school district will have all options available in providing education and services. I would urge all members to join me in Co-Sponsoring this legislation that will greatly improve the progress of students with special needs toward their IEP goals.
