| I plan on introducing legislation next week that would require PennDOT to resume the operation of the Commonwealth's Motorcycle Safety Education Program, while also ensuring the program adheres to the social distancing practices and other mitigation measures defined by the CDC. On April 18, 2020, PennDOT ended its contractual relationship with the Department's contracted party due to disagreements over terms of continuing payments during this pandemic. However, the Department has a statutory requirement in Title 75 to provide the Motorcycle Safety Education Program, which is outlined in Section 7911. Moreover, the Motorcycle Safety Education Program plays an integral role in how citizens can be issued a motorcycle license or permit. With the Department's announcement that the Program could potentially be suspended for the remainder of the year, many citizens will now be subject to additional obstacles to obtain such a license or permit, in addition to the many hardships brought by this pandemic. My legislation would stipulate that the Department has 30 days from enactment to enter a new contract with a third party to permit the continuation of the program and require DCED to immediately issue a waiver to the awarded party. To ensure the program adheres to social distancing practices and other measures defined by the CDC to mitigate the spread of the coronavirus, PennDOT will have the discretion to decide the duration that the awarded party must implement and practice such meansures. I strongly believe citizens can utilize this program and still adhere to common sense social distancing practices. If PennDOT can offer controlled CDL testing at a limited number of sites while practicing proper social distancing measure, then so can this program.
