House of Representatives
Session of 2019 - 2020 Regular Session

MEMORANDUM

Posted: May 6, 2020 04:50 PM
From: Representative Dan L. Miller
To: All House members
Subject: Paid COVID-19 Leave

The federal Families First Coronavirus Response Act required (among other things) employers with 50-500 employees to pay sick leave related to COVID-19. The bill mandated an additional 80 paid sick leave hours on top of any existing contractor collective bargaining agreement for each full-time worker, and 40 for part-time. Unfortunately, this cap excluded larger employers, many of whom are essential to our manufacturing and food production.

My bill takes those same COVID-19 paid sick leave benefits and applies them to every Pennsylvanian who works for an employer with over 500 employees. In addition to requiring that those large employers provide additional paid sick leave for all employees (part-time and full-time), my bill prohibits:

  • Requirements that employees use other paid leave before using this leave;
  • Requirements that employees must find a replacement to cover their scheduled work hours;
  • Retaliation against any employee who takes this leave, and
  • Retaliation against any employee who files a complaint or engages in efforts to enforce paid sick leave requirements.
Additionally, the bill expands coverage to include this enhanced paid sick leave requirements for our emergency responders and healthcare workers who are personally infected with COVID-19, or believed to be.

Please consider joining me in co-sponsoring this legislation.
