In the near future I plan to introduce legislation that will amend Section 7301 (f) of Title 35 (Health and Safety) to require that in the context of an Emergency Declaration, all records granting or denying any waiver, exclusion or other exception to a governor’s executive order shall be posted on a publicly accessible internet website within 24 hours of the grant or denial. Members of the public, the press, and the General Assembly have all asked the Executive Branch for this information but have, to date, been denied. Effectively, all public access to this information has been prevented. Transparency in government is essential at all times and is an important part of the checks and balances system within our form of government. Individuals, as citizens of this Commonwealth, have a right to this information since it ultimately belongs to and affects them. The press has a right to this information so it can, with the fullest amount of information available, carry out its reporting. The General Assembly, as a co-equal branch of government, has a right to this information so that it can exercise its oversight capacity of the Executive Branch and be responsive to the citizens it serves.
