Subject: Resolution Requesting Guidance for the Use of CBD and CBD Products
 
In the near future, I plan to introduce a resolution which would encourage the FDA to provide guidelines to the state with respect to CDB and proliferation of CBD products.

Currently there are no guidelines to protect and inform consumers about what these products contain or the quality of their effectiveness.

In 2018 the Federal Farm bill allowed for the use of CBD and classified it as an agricultural commodity in very limited circumstances. The product must be derived from industrial help; must contain less than 0.3% of THC; must adhere to state-federal regulations; and must be grown from properly licensed growers. Despite these tight limitations, CBD is being advertised widely and is available in many convenience stores, online retailers and even in boutique locations.

Due to the lack of FDA oversight, however, there is no quality standards for CBD oil and little consistence across the market. Retailers are not aware of their ability to legally sell CBD products and if the CBD they purchase is legal under the new standards.

Consumers need these protections in place to ensure they are getting what they pay for.

I call on the FDA to provide standards and guidelines for the states to follow to implement standards for CBD products so we can ensure the safety and quality of these products which are being rushed to market. These standards will provide our retailers with the ability to property market the products and ensure the public of their safety.
