Subject: Amending the UCC to create an "inactive status" option for certified code officials.
 
In the near future, I plan to introduce legislation that will amend the Uniform Construction Code (UCC) to allow the Department of Labor and Industry (DLI) to create a process that permits certified code officials to maintain their UCC certification on "inactive status" for code officials who need time away from the profession for personal and family-related matters, or who are experiencing a temporary relocation outside of the Commonwealth.

Under current operations, in addition to the requirements of the PA UCC, code officials are also subject to holding and maintaining International Code Council (ICC) certifications. In order to maintain an ICC certification, an individual is required to complete 60 Continuing Educational Units (CEU's) during the three-year-cycle. These credits are applicable to maintain PA UCC certifications as well, which requires 45 CEU's.

Under current law, if an application for certification renewal for UCC certifications is not received by DLI within one year of the expiration date listed on the certification card, the holder will only be recertified upon providing proof that he/she retested and passed all examinations required for each category of certification.

A constituent of mine who is a code administrator, recently took some time away from his profession to care for a family member. When he was ready to re-enter the workforce, he was informed by DLI that he was unable to be recertified under the UCC because his certification lapsed, even though his ICC certifications were valid for three more years.

It is not uncommon for individuals licensed in the state of Pennsylvania to hold their license on "inactive status." I believe this same flexibility should be offered to the hard-working code officials within this Commonwealth who need some time away from their profession to deal with personal matters.
