Subject: Title 68 Cleanup Bill
 
In the near future I plan to introduce a bill with some technical changes for Title 68 regarding planned communities, cooperatives, and condominiums.

The bill will amend portions of Title 68 (Real and Personal Property), within the Uniform Condominium Act, the Real Estate Cooperative Act and the Uniform Planned Community Act by:
  • Requiring that the Declaration include a description of all fees or charges which Unit Owners will be required to pay for use of Common Elements, Limited Common Elements or any other facilities, and clarifying such requirement already specified for public offering statements.
  • Providing a procedure for facilitating corrective amendments to bylaws and codes of regulations similar to the procedure for effecting corrective amendments to declarations; and clarifying the requirement for an opinion from legal counsel in both cases.

These changes will update the provisions of Title 68 to clarify some portions of the current law to remove any question of intent and to make necessary technical changes.
