MEMORANDUM

Posted: April 11, 2019 03:51 PM
From: Representative Gary Day
To: All House members
Subject: Bottled Water Regulations

In the near future, I will be introducing legislation that will streamline/consolidate the process of inspection of water bottles. It has been brought to my attention that water bottles that are over ½ gallon are inspected by Department of Environmental Protection (DEP) and are considered to be public water systems, while the bottles under ½ gallon are inspected by Department of Agriculture (DOA) and are considered to be food products. This leads to burdensome requirements and permitting delays for bottled water companies, while not improving the safety of bottled water products for consumers.

In addition, DEP certifies certain water treatments for bottled water plants it regulates but cannot certify the same treatments used in plants under DOA jurisdiction. This can lead to major impediments to production and can negatively impact the economic vitality of the industry in the Commonwealth.

Please consider co-sponsoring this legislation that will make the inspection of water bottles more effective and efficient for all entities.

Introduced as HB1972
