MEMORANDUM

Posted: March 12, 2019 09:26 AM
From: Representative Donna Bullock and Rep. Stephen Kinsey
To: All House members
Subject: Prohibition on Arrest Records as a Condition of Housing Leases

In Pennsylvania, a person or family can be denied a rental property based off of an arrest or conviction from years or decades ago. Many of these individuals were never convicted, completed a deferred judgement program or have since turned their lives around. These arbitrary requirements make it difficult for some families to find decent housing.

My legislation would prohibit landlords from inquiring or requiring disclosure about certain arrest records of potential tenants as a condition of a lease. Some of these records would include: juvenile records, arrests with no convictions, convictions older than seven years, or any convictions which is not a felony or misdemeanor.

I ask that you support this legislation and join me in helping ensure Pennsylvanians have a fair chance at housing and not be punished for past mistakes.

Introduced as HB1070
