Subject: | Reinstate The Subsidized Permanent Legal Custodianship Program and its Provisions |
In the near future I will be introducing legislation to reinstate the extension of permanent legal custodian and adoption assistance subsidies to children from 18 to 21 years of age. The subsidies are provided through the Subsidized Permanent Legal Custodianship Program, which allows family members who are granted permanent legal custodianship for qualified children under Kinship Care to receive a subsidy. The Subsidized Permanent Legal Custodianship Program, which was codified in the Human Services Code in Act 80 of 2012, was invalidated last July when Act 80 of 2012 was ruled unconstitutional by the Pennsylvania Supreme Court. So, it is necessary to reinstate the program and its provisions in order to continue to be eligible for federal Title IV-E funds. My legislation does just that. It re-enacts in the Human Services Code the relevant section that establishes the Subsidized Permanent Legal Custodianship Program. It also re-enacts the sections addressing the permanent legal custodianship subsidy and reimbursement; definitions and the Kinship Care Program. These are effective retroactive to July 1, 2012, the effective date of Act 80. Please consider signing on in support of this important legislation. |
