MEMORANDUM

Posted: February 7, 2019 10:13 AM
From: Representative Rob W. Kauffman
To: All House members
Subject: Display of Honor and Remember Flag

In the near future, I am planning to re-introduce legislation that would amend the American, Commonwealth and Military Flag Act of 2006, to provide for the display of the Honor and Remember Flag in Pennsylvania (formerly House Bill 252).

Current law allows for the flying of certain flags in communities governed by residential association rules. The Flag of the United States and the Flag of the Commonwealth of Pennsylvania may be flown at any time. Flags of the branches of the United States military services must at least be permitted to be displayed on the commemorative occasions—such as Armed Forces Day and Memorial Day—enumerated in the Act. Property management organizations retain the right to regulate the size, location and use of a flag pole, but they cannot prohibit the use of a wall bracket to display a patriotic flag. The size of the flags displayed are limited to 5x3 feet. Additionally, cemeteries must allow flags to be displayed in a manner consistent with federal law.

My legislation would expand the freedom to display to include the Honor and Remember Flag. The Honor and Remember Flag is an emblem of service and sacrifice of the brave men and women of the United States Armed Forces who have given their lives in the line of duty. I believe this bill seeks a reasonable exception to allow citizens to fly a symbol of gratitude to our fallen service men and women, and their families.

Please join me in sponsoring this bill, which recognizes and thanks our soldiers for their contribution to our freedoms. Thank you.
