MEMORANDUM

Posted: January 11, 2019 11:57 AM
From: Representative Frank A. Farry
To: All House members
Subject: Tampering with Food Legislation (Prior HB 1861)

In the near future, I will reintroduce legislation to make it a crime to introduce any bodily fluid or any object or foreign substance into a police officer's or first responder’s food. Under current law, it is not clear that this disgusting and potentially harmful act constitutes assault. My bill will make it a misdemeanor of the third degree. If the action causes bodily injury, it will be a misdemeanor of the first degree.

Incidents of violence and harassment against police have risen dramatically. Today, police officers are increasingly refused service and often report finding harmful objects and substances in their food. In August 2016, a Subway employee in Utah reportedly put meth and THC in a police officer’s fountain-dispensed lemonade as a prank. And at myriad locations around the country, law enforcement officers have reported finding everything from drugs and glass to spit and pubic hair intentionally planted in their meals. Our first responders deserve to be confident in their safety when they order food and dine in a public place.

Please join me in cosponsoring this important piece of legislation. Thank you.

Introduced as HB1301
