Subject: Giving a Local Share of Controlled Substances Forfeiture Proceeds
 
Municipalities are always on tight budgets with resources stretched thin. Municipal police are no exception and their time and efforts are increasingly valuable.

As it stands, even when municipal police spend significant time in seizing property in the course of controlled substances enforcement, they stand to gain none of the value of the seized property once forfeited.

These local police spend many hours and resources in the events leading up to those arrests, and yet they receive zero when the forfeited property is sold. This should be changed.

The proposed law will establish that whenever a municipal police agency was substantially involved in the seizure of property ultimately forfeited by the court, at least 25% of the proceeds will be distributed to the municipal police agency.

This legislation would simply recognize the time and money these local agencies spend and provide them a minimum of one-quarter of the value of the seized assets.

Last session this was HB 457.
