Subject: Pharmacy Gag Clauses

Pharmacists throughout the Commonwealth have been voicing their frustration about not being able to save customers money on their prescription drugs. This is because many contracts between pharmacy benefit managers (PBMs) and pharmacies have what are known as “gag clauses” written into them.

A “gag clause” prevents a pharmacist from disclosing information to customers that could lower their out-of-pocket costs for their drugs. For example, some generic drugs are cheaper if they are paid for out-of-pocket rather than through insurance because the co-pay is extremely high.

Please help me make this change so that we can save Pennsylvanians money at the pharmacy desk.

Introduced as HB570
