Subject: Fundamental Rights for Public-Sector Union Members
 
Please find attached a copy of legislation I plan to introduce which amends the Public Employe Relations Act (Act 195 of 1970) to formally establish public-sector union member rights that are based directly on rights already established under the federal Labor Management Reporting and Disclosure Act (LMRDA) for private sector unions. The legislation clearly establishes the right of union members to:
  • Nominate union officer candidates and the freedom to advocate for such candidates.
  • Vote in union elections or referendums and support candidates they choose.
  • Participate in deliberations of membership meetings and to be free to express opinions at such meetings.
  • Vote on business at membership meetings.
  • Have the freedom to meet and assemble freely with other union members.
  • Have notice and fair hearing for disciplinary measures.
  • Not have membership dues increase without a vote by members to approve any increase.

The legislation also includes establishing annual reporting requirements modeled on federal law that includes information on union expenditures, officer salaries, travel, and other pertinent information.

Many unions in the Commonwealth cover both private- sector and public-sector unions, and thus are already covered by LMRDA and subject to its internal operations guidelines. However, for those public-sector unions that there are not subject to LMRDA, there is are no formal statutory requirements; the Public Employee Relations Act and regulations promulgated pursuant to it do not establish any guidelines for how unions are to operate internally.

I believe that we need to ensure that our constituents who are members of public sector unions have formal rights within the union structure and should have accountability by their union officers. Therefore, I’m asking you to stand with me and support this important piece of legislation. Thank you.
