Subject: Exemption of Public Preschool Rec Programs
 



In the near future I will introduce legislation that would exempt public pre-school recreation programs from being required to be certified by the Department of Human Services as child care facilities.

Under current regulation (PA Code, Section 3270.3a), such programs are required to be certified as child care facilities if they provide part-day care for children who are under kindergarten age and considered preschoolers. While there is an exemption in the regulations for rec programs attended by school-age children that last less than 90 days, there is no such exemption for those programs that serve pre-school children.

This issue was brought to my attention by a municipality in my legislative district that operates a summer camp for children, including children ages 3-5. Organizers of that program feel that camps or other public recreation programs serving pre-school children should be exempt from the certification requirement.

The legislation I am proposing simply would amend the definition of “child day care center” in the Human Services Code by stipulating that this defined term does not include public pre-school recreation programs.
