Subject: | Co-sponsorship of Legislation – Home Improvement Guarantee Fund |
In the near future, I plan to re-introduce legislation, formerly introduced as HB352 during the 2015-2016 Legislative Session, to amend Act 132 of 2008, the Home Improvement Consumer Protection Act, to increase consumer protections related to new home construction. Specifically, this legislation would establish the Home Improvement Guaranty Fund within the State Treasury and be administered by the Bureau of Consumer Protection in the Attorney General’s Office. A contractor that registers their business in compliance with Act 132 will pay a fee of $100 biennially to the fund. The money will be used to compensate consumers for the actual loss that results from an act or omission by a contractor in the performance of services, as well as a court determined violation of Act 132. Additionally, this legislation includes further protections against home construction fraud and requires home builders to notify consumers of building products known to be defective.
