Subject: Sale of Toy or Imitation Firearms (Former HB 1545)
 
In the near future, I plan to reintroduce legislation that amends Title 18 (Crimes and Offenses) of the Pennsylvania Consolidated Statutes prohibiting the sale of toy or imitation firearms, unless the toy or imitation is constructed in such a way that it is obviously not a real firearm.

The determination as to whether a gun is real or fake needs to be made in most instances within a split second, especially in situations when one is considering whether to defend themselves against a threat. Unfortunately, the decision is hindered because of the sale of toy or imitation firearms that cannot be easily distinguished from a real firearm.


When these toy or imitation firearms are mistaken for real firearms, there can be and have been devastating consequences. In Philadelphia alone, at least 16 people carrying toy or imitation firearms have been shot by Philadelphia police between 2007 and 2013. At least 12 states, Washington D.C., Puerto Rico and numerous large cities throughout the United States have enacted legislation restricting the sale or use of toy and imitation firearms. I feel it only makes sense for Pennsylvania to do the same.
