Subject: Amending the Mental Health Procedures Act (Prior HB 1504)
 
In the near future, I plan to reintroduce legislation amending the Mental Health Procedures Act to remove the 30 day standard for determining that a person presents a clear and present danger to himself or others. This standard in the law requires prescience on the part of the evaluating professional to determine that if left untreated, the person is likely to come to harm within thirty days. Removing the thirty days from the law allows for the determination to be based on the person’s current state of mind and the likelihood that harm may befall someone at some point in the future if the person’s mental health needs remain unaddressed.
