Subject: Pennsylvania Industrial Development Authority-Defining the term "agent"
 
The Pennsylvania Industrial Development Authority created by the act of May 17, (1956) 1955, P.L. 1609, No. 537 (PIDA) is an independent authority that manages certain economic development programs for the Commonwealth and governed by a board of directors. Under current law, a business that applies for or receives assistance is required to permit authorized employees of PIDA or its agent to inspect the plant, books and records of the business. There are currently no direct employees of PIDA as PIDA is staffed by employees of the Department of Community and Economic Development (“DCED”). Additionally, existing law does not define the term “agent.”

In the near future, I will be introducing legislation that will amend Chapters 23 (Small Business First), 29 (Machinery and Equipment Loans) and 30 (Pennsylvania Industrial Development Program) of Title 12 (Commerce) to define the term “agent” to include the Department of Community and Economic Development giving it and its employees the ability to conduct the required inspections and monitoring for each program.
