Subject: Credit for Suspension
 
In the near future, I plan to introduce legislation that would amend Title 75 (Transportation) Chapter 15, Subchapter B regarding time served under suspension to allow those with suspended licenses to accrue credit for time once their license expires.

Currently, suspension time for a driver’s license begins when a valid license is surrendered or an acknowledgement of suspension is returned to the department. My legislation would automatically begin the suspension once a driver’s license has expired if the existing methods were not used.

Experience shows individuals that got in trouble in their teens or early twenties who are now in their thirties and have families. For them, the road to employment and providing for their family is being able to drive. Since they never acknowledged their suspension to the Commonwealth, time toward it has never begun. Since their infraction, they have a clean record but still have to serve a lengthy term to get licensed.

Under my legislation, once the license expires suspension time would automatically begin. All other factors involved in the license becoming restored are still are in effect – liens, restoration fees, judgements (DUI treatment). The change would only affect one’s eligibility date.
