Subject:	Fiream Exemption

Pennsylvania law currently exempts numerous types of property from collection on a court judgment, or in a bankruptcy. Those exemptions include such things as a homestead exemption, pension proceeds, veterans’ benefits, and personal items like clothing, bibles, uniforms, and school books. I propose adding a new exemption that would exempt from judgment collectors up to three firearms possessed by an individual debtor. Thirteen states already provide for this type of exemption, which often lists some number or variety of firearms among the personal items exempt from judgment. Among those states that provide protection, the conditions for providing that protection vary. Some limit the exemption by the value of each firearm or the aggregate value of all; some specify types of firearms that can be exempted. I propose that Pennsylvania simply allow individuals to exempt no more than three firearms of their own choosing. The Second Amendment of the U.S. Constitution and Article I, Section 21 of the Pennsylvania Constitution keeps sacrosanct the people’s right to keep and bear arm. I hope you will join me in sponsoring this sensible exemption from judgments as a way of protecting the ability of individuals to exercise these constitutional rights and protect themselves regardless of their economic circumstances.
