Subject:	Eliminating Background Clearances for Interns who are 17+

My legislation will amend Title 23 (Domestic Relations) of the Pennsylvania Consolidated Statutes, in child protective services, further providing for definitions, for persons required to file background check clearances as it relates to work-study/internship programs. As you know, Act 15 of 2015, helped clarify that work-study/internship program(s), would limit the background check clearances to one adult supervisor of the program, in which the student has immediate and regular contact with, as defined in the bill as in the student’s “immediate vicinity.’’ The military accepts 17 year old men and women for the service without requiring their supervisory personnel to go through this type of check. There is also no requirement for checks for employers who hire 17 year olds separately from school programs. Since a 17 year old would be able to work in these environments without the need for a check if they did so absent a link to a school, my legislation eliminates the requirement for background clearances for individuals and employers if the minor participating in the work-study/internship is at least 17 years of age or older.
