Subject: Procurement Code - Executive Order 2015-02
 
As you may know, on his first day in office, Governor Tom Wolf signed Executive Order 2015-02, Competitive Process for Procurement of Legal Services. In the near future I will be introducing legislation that will follow the competitive bidding procedures outlined in the Procurement Code and apply them to awarding contracts for legal services or legal consultations.

Under this legislation, the Office of General Counsel will determine the categories of legal services or types of cases that may be supplied by outside lawyers; develop a competitive bid list of preapproved lawyers that can be used for emergency situations; identify the circumstances in which the awarding of legal services are permissible and implement a system to award contracts.

In order for an executive agency to obtain the services of an outside lawyer, that agency must submit a written request for authorization to the Office of General Counsel. The written request must contain the justification as to why the executive agency needs outside legal services, a detailed estimate of the time and labor that is required by the outside counsel, a description of the specific legal skill or expertise needed to represent the executive agency and a determination that the need for outside services is cost effective and in the best interests of the public. Upon receipt of the written request, the Office of General Counsel will review and either approve or disapprove the request. If approved, the Office of General Counsel will supply a written notice to the executive agency authorizing them to proceed under either section 518 or section 512.1 of the Procurement Code. If disapproved, the Office of General Counsel will supply a written notice to the executive agency explaining why they are prohibited from securing outside legal services.
