MEMORANDUM

Posted: February 13, 2015 02:18 PM
From: Representative Jim Marshall
To: All House members
Subject: Motorized Wheelchair While Hunting

I plan to introduce legislation that will allow for those who are disabled and permanently confined to a wheelchair to use that device while hunting.

As you may know, under current law vehicles are allowed for use as blinds for those with a disabled person permit. However, the hunter’s firearm must be unloaded any time the vehicle is in motion. Currently, there is no exemption for motorized wheelchairs, which means someone who is disabled must power off their wheelchair every time they wish to load their weapon.

I believe that there should be a lawful difference between a vehicle and these essential tools for our disabled citizens.

Specifically, my proposal will amend Title 34 and will specify that a motorized wheelchair is not unlawful, and that a firearm may be loaded while the device is in motion, given that the user has a disabled person permit and cannot walk.

Thank you and I hope you will consider joining me in support of this legislation.
