Subject: Workers' Compensation Protection for Emergency Medical Service Agencies - House Bill 611 of Last Session
 
In the near future, I will re-introduce House Bill 611 of last session, which would amend Section 601 of the Workers’ Compensation Act. This legislation will remove the ambiguity that currently exists regarding Workers' Compensation (WC) protection for members of emergency medical services agencies with both paid and volunteer members.

It has been brought to my attention that underwriting WC insurance has in many cases brought confusion and disagreement between our local municipalities and the insurance companies, as well as the EMS agencies and their volunteers. The question that has been asked is whether volunteers of an EMS agency that is organized as a 501(c)(3) and has paid responders, are to be listed on the local municipality’s WC policy
.
In order to draw a clear distinction that the municipality is responsible for the provision of workers' compensation coverage for the volunteer EMS responders, similar to what we do for our volunteer firefighters, the Workers’ Compensation Act needs amended to clarify this very important issue affecting our volunteer emergency medical responders, as well as the EMS agencies that serve our communities.

Please join me in ensuring that our volunteer emergency medical responders are fully and adequately covered by Workers' Comp Insurance when performing their duties.

House Bill 611 passed the House in November of 2013 by a vote of 197 – 0.
