Subject: Credit Card Verification Procedue Act
 
In the near future, I will be re-introducing legislation to create the Credit Card Verification Procedure Act. This legislation was previously introduced as HB 584 (2013-2014.)

The bill will require credit card issuers who mail offers or solicitations to verify a consumer’s address upon acceptance of the offer or solicitation if the address given by the consumer is different from the address where the offer or solicitation was sent. This legislation also establishes an address verification procedure for credit card issuers.

Additionally, the bill provides that the person to whom an offer or solicitation was originally made will not be liable for the unauthorized use of a credit card if the credit card issuer failed to verify the address. This provision will not apply if a credit card issuer can prove that the person to whom an offer or solicitation was made actually incurred the charges on the credit card.

Finally, the bill requires a credit card issuer to verify an address if there has been a change of address on an account and within 10 days of the change of address an additional card is requested. A credit card issuer shall not mail or activate an additional card unless the address has been verified. Similar pieces of legislation have been introduced in Nevada and California.
