Colleagues, as recommended in the Restitution Task Force‘s Final Report, I plan to introduce legislation that would ensure that the costs incurred by counties in their restitution collections enforcement activities are included as enumerated costs in §9728 of 42 Pa.C.S. (Judiciary and Judicial Procedure). Section 9728 governs the collection of restitution, reparation, fees, costs, fines, and penalties from criminal offenders. However, since §9728 does not currently include costs associated with the collections enforcement activities undertaken by the county, my legislative proposal would incorporate those costs, including general operating expenses, into §9728 as statutorily authorized expenses, which must be paid by the offender. In 2011, the Office of Victim Advocate convened The Restitution in Pennsylvania Task Force to study and develop recommendations for improving the restitution process in Pennsylvania on both the State and local levels. The Restitution Task Force issued its Final Report (February 2014) with a series of administrative, operational, and legislative recommendations. One legislative recommendation evolved from the belief that counties would have more resources to fund their collections enforcement activities, if the expenses they incurred were borne by offenders.
