Subject: Commission on Realignment & Restructuring of State Government - Former HB 131
 

In the near future, I plan to introduce legislation that would provide for the establishment of a Commission on Realignment and Restructuring of State Government within the Office of the Governor.

Under the proposal, the Commission would be tasked with conducting a comprehensive analysis and evaluation of the core functions of agencies of the Executive Department. The analysis and evaluation would extend to all services, programs, and delivery methods for the purpose, among other things, of identifying opportunities for creating efficiencies in State government. This would include consolidating or eliminating redundant and unnecessary programs, service, agencies, and regulations, and reducing spending.

The Commission would make recommendations for executive orders or legislative proposals to the General Assembly and the Governor, as the case may be, to implement its recommendations. The Commission would consist of eleven members with one each appointed by the Legislative Leaders and seven appointed by the Governor. Of the individuals appointed to the Commission, none could be Members of the General Assembly, the Governor’s Office or Governor’s Cabinet, relatives of such individuals, or registered lobbyists. Two individuals appointed to the Commission would have to be college students. Moreover, in making these appointments, an appointing authority would assure that the composition of the group is representative of and reflects the age, gender, ethnic, and geographic diversity of this Commonwealth.

Among other specific “good government” initiatives, the Commission would be tasked with making recommendations for: 1) eliminating unnecessary agencies, creating necessary agencies, reorganizing existing agencies, and transferring core functions and responsibilities among agencies; 2) adopting methods and procedures for reducing executive department spending to the lowest amount consistent with the efficient performance of essential core functions; 3) studying and identifying approaches to minimize or simplify regulatory reporting and compliance requirements for business and eliminate unnecessary or poorly defined regulations, taking into account the different capacities of small and large businesses and compliance requirements that impose unnecessary external regulatory cost and reporting burden; and 4) making agency data and information accessible to the public in an effort to provide for greater openness and accountability.

The Commission would issue an initial report of its findings and recommendations to the Governor and General Assembly no later than June 30, 2014, with subsequent reports being issued every six months thereafter. The act would expire January 1, 2019, unless reenacted by the General Assembly.
