Subject: Discretion of Waterways Conservation Officers
 
In the near future, I plan to introduce legislation amending Title 34 (Game) and Title 30 (Fish) to clarify the discretion of Wildlife and Waterways Conservation Officers to issue written or verbal warnings, when appropriate, in lieu of arrests or citations for violations of the Game Code and Fish and Boat Code.

As a former police officer, I know the importance of the proper use of discretion in law enforcement. While conservation officers currently have the ability to exercise this discretion, it is not specifically granted in statute, and therefore I believe that this option is possibly not being used to the extent it could or should be used. It is my intent with this legislation to provide a comfort level, both for those officers and for sportsmen and sportswomen in the field, concerning this existing authority by placing such authority for discretion clearly in statute.
