Subject: Introduction of Legislation Requiring Sellers of Mobile & Manufactured Homes to Obtain a Tax Status Certification as a Condition of Sale
 
Senator John P. Blake has kindly worked with me on legislation that would amend Title 75 (Vehicles), of the PA Consolidated Statutes, to require sellers of mobile and manufactured homes to obtain a tax status certification as a condition of the sale. Senator Blake will introduce the legislation in the Senate, while I will soon introduce it in the House. I kindly request co-sponsors to this legislation.

This legislation originated from concerns of a county tax claim official, who expressed frustration at the many mobile home owners that move out of state after selling homes on which they owe delinquent property taxes. The purchasers of the mobile home often learn of the delinquency only after a sale becomes final because Pennsylvania law has no requirement for a title or tax status check for such sales. The delinquent taxes get assessed to the parcel number, not the owner, which causes the new owners to possibly lose their homes unless they pay the previous owner’s delinquency.

This bill would prevent that problem by requiring a tax status certification to include a statement from the tax collection authority of a municipality and the county tax claim bureau or its equivalent office as to any taxes owed or in delinquency. This change will require the current owner to pay any owed or delinquent taxes before a sale can occur. This legislation provides two benefits. It assists municipalities and tax collection authorities in collecting owed and/or delinquent taxes. It also ensures that upstanding citizens who buy a mobile home don’t end up having to then also pay for the tax bill or delinquency of the prior owner. The Commonwealth has the same requirement for all other sales involving other types of homes and/or real estate and property taxes.

The Pennsylvania Manufactured Housing Association gave its input on the drafting of the legislation and supports the change as do a host of county tax claim officials from around the state.
