Session of 2013 - 2014 Regular Session

MEMORANDUM

Posted: February 14, 2013 12:07 PM
From: Representative Robert F. Matzie
To: All House members
Subject: Juror Compensation and Tax Credit

In the near future, I intend to re-introduce legislation amending Title 42 (Judiciary and Judicial Procedure) of the Pennsylvania Consolidated Statutes, which would change the way that the Commonwealth compensates jurors.

It is important that Pennsylvania law supports citizens in the performance of their civic duty to serve on a jury if summoned. Under current law, jurors are paid $9 a day for the first three days of service and $25 a day for each day thereafter. This payment methodology creates a hardship for many residents who are summoned. As such, my legislation would require employers to pay a juror’s ordinary wage or salary each day that the employee is required to report for service and the Commonwealth will grant a tax credit to the employer for the amount expended.

The bill also addresses compensation for unemployed and self-employed individuals to ensure no unnecessary hardship results from their service, and addresses parking and travel allowances for all jurors.

Introduced as HB1009
