Subject: Lobbyist Disclosure Penalties-(Former HB 103)
 
We invite you to join with me in cosponsoring a bill that we will be introducing in the near future that amends the recently enacted Lobbyist Disclosure Law to enhance the penalties found in that statute.

The people of Pennsylvania deserve to know that there are stiff penalties for failure to comply with a law designed to inform them of who is influencing their government and how they are influencing state policy makers.

Our bill does the following:

  1. Increases the fines associated with simple noncompliance from $2,000 to $10,000, and gives the State Ethics Commission the authority to prohibit a lobbyist from lobbying for economic consideration for up to 10 years (currently set at 5 years).
  2. Increases the fine for negligent failure to register or report from $50 for each day late to $250 for each day late.
  3. Increases the penalties for intentional violations as follows:

  1. Intentionally failing to register or report would now be a misdemeanor of the first degree (up from a second degree misdemeanor).
  2. Intentionally filing a report with knowledge that the report contains a false statement would now be a misdemeanor of the first degree (up from a second degree misdemeanor).
  3. Other intentional violations of the law would result in a misdemeanor of the second degree (up from a third degree misdemeanor).
  4. Financial penalties are that could be imposed by a court against a principal who violates the act are increased from $25,000 to $100,000.
  5. Gives the State Ethics Commission the authority to prohibit a lobbyist from lobbying for economic consideration for up to 10 years (currently set at 5 years).

Please join us in cosponsoring this bill so that Pennsylvania’s new Lobbyist Disclosure Act accomplishes what it is intended to do – provide full disclosure of those who work to influence state government officials.
