Subject:	Creation of Municipal Storm Water Authorities

In the near future, I plan to introduce legislation that would amend Title 53 (Municipalities Generally) to expressly provide municipal authorities with the power to engage in storm water management, planning, and projects. The creation of a storm water authority is not a mandate but an optional power granted under the Municipality Authorities Act. Storm water management is typically a regional issue defined by watersheds rather than municipal boundaries. It is difficult for an individual municipality within a watershed to address the storm water issue on its own as other municipalities, either upstream or downstream, may be approaching the problem differently, if at all, resulting in a disjointed effort and effect. Additionally, municipalities are seeking tools to help them respond to the escalating costs of storm water management to address regulatory requirements and flooding problems. The creation of storm water authorities would help create a stable source of funding for storm water management, planning, and projects.
