MEMORANDUM

Posted: January 25, 2013 09:57 AM

To: All House members
Subject: Limit Taxing Power for Municipalities with Distressed Pension Plans

My legislation would amend the Municipal Pension Plan Funding Standard and Recovery Act (Act 205 of 1984) regarding extra taxing power given to municipalities with distressed pension plans.

Currently, municipalities with distressed pension plans are legally imposing a tax upon people who work within a distressed municipality, but do not live there. My legislation would exempt non-residents who work within a distressed municipality from having to pay this tax. Therefore, restricting taxing powers strictly upon the residents who live within the distressed municipality.

This is a reintroduction of former HB 2294. Previous cosponsors include; CREIGHTON, FARRY, FLECK, GABLER, GINGRICH, GRELL, GROVE, HESS, HORNAMAN, MILLER, QUINN, SAYLOR and VULAKOVICH.

I appreciate your consideration and support. Please direct any questions to Christine at; ccrone@pahousegop.com. Thank you.
