Subject: Co-Sponsorship Request – Pennsylvania Supreme Court’s Rules of Criminal Procedure Resolution (Former HR351)
 
In the near future, we plan to reintroduce a resolution to urge the Supreme Court of Pennsylvania to adopt the proposed Rules of Criminal Procedure 513 and 513.1, which will deliver a fair balance between providing the public with arrest information and law enforcement with the necessary confidentiality to ensure that ongoing investigations are not compromised.

When we began researching this need for balance between the public and law enforcement officials, two factors were brought to our attention. First, statutory pronouncements related to this area could potentially conflict with the current Rules of Criminal Procedure that are promulgated by the Pennsylvania Supreme Court. Secondly, the Criminal Procedural Rules Committee examined this issue and proposed amendments and additions to the current Rules of Criminal Procedure. These proposed rules strike a necessary fair balance, which is the crucial result that is needed. In fact, these new rules accomplish that which we sought through legislation.

Accordingly, we are proposing the introduction of a resolution calling on the Pennsylvania Supreme Court to approve and adopt the amendments and additions of the Rules of Criminal Procedure 513 and 513.1. We invite you to join this resolution, which ultimately urges the Court to adopt rules that continue to provide transparency to the public, while offering law enforcement officials necessary discretion to ensure that investigations are not compromised.
