Subject: Revoking Parole for Failing a Drug Test (Former HB 559)
 
This legislation amends the Pennsylvania Board of Probation and Parole Law to increase the Board’s power to revoke parole for persons testing positive for illegal drugs.

Current law establishes that “testing clean” is a condition of continued parole for persons who, as inmates, tested positive for a controlled substance or designer drug, or who were paroled from a sentence arising under the Controlled Substance Act, or from a drug-related crime. Random testing is performed at the Board’s discretion, and the costs of the drug testing are borne by the parolee.

My bill will extend the ability of the Board to revoke parole for parolees who fail drug testing by including the following parolees in its requirement for random drug testing: persons who are paroled from a sentence arising from a crime of violence, or from any felony conviction.

I believe this measure will have a strong deterrent effect on parolees, and will also enhance the level of safety in our communities by returning un-rehabilitated parolees to prison.
