Subject: Separations Act (formerly HB 2028)
 
I plan to re-introduce legislation to help school districts cut their cost and better manage school construction projects by providing them with the option to use a single prime delivery system instead of the often more costly multi-prime delivery system.

Under the currently mandated multiple prime contractor system, a school district must bid separately for each component of a school construction project, such as general construction, plumbing, HVAC, and electrical. As a result of this multiple prime system, each contractor works independently and simultaneously on a construction project, requiring the school district to engage an employee to coordinate and oversee these multiple contractors or to hire outside assistance, such as a construction manager, to do so. Many school districts report that compliance with the multiple prime contractor mandate is inefficient and unnecessarily increases the cost of school construction projects as a result of increased administrative burden, legal costs, schedule overruns, and change orders.

My legislation will relieve school districts of the mandate to comply with the Separations Act and will give them the flexibility to determine whether a single or multiple prime delivery system provides the most efficient and cost-effective way to complete a project. Allowing such flexibility was a recommendation of the Task Force on School Cost Reduction issued in November 2007.
